Terms of Service

These Terms of Service (the "Terms") govern your use of CrispVid, including the website at crispvid.com and the CrispVid app for Mac (together, the "Service"), provided by CrispVid ("CrispVid", "we", "our", or "us"). By creating a CrispVid account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

CrispVid enhances and upscales videos you provide. Results depend on the quality, format, and content of your source video, and we do not guarantee any particular result, quality level, or processing time. We may add, change, suspend, or remove any part of the Service at any time.

2. Eligibility

You must be at least 13 years old, or the minimum age required to use online services in your country, to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms.

3. Your CrispVid Account

Your CrispVid account is identified by its email address: signing in with Google, with Apple, or with an email verification code using the same email address gives access to the same CrispVid account.

You are responsible for keeping your sign-in methods secure, including your email account and your Google or Apple account. Any activity carried out while signed in to your CrispVid account, including purchases, use of credits, and account deletion, is treated as your own activity. If you believe someone has accessed your CrispVid account without permission, contact us right away. Our records of account activity may be used to resolve questions or disputes about your CrispVid account.

4. Credits

Some features of the Service are paid for with credits, which can be purchased on crispvid.com or, where offered, through in-app purchase. Credits are deducted when processing starts.

Credits have no cash value, cannot be transferred, exchanged, or redeemed for money, and are non-refundable, except where required by law. We may change the price of credits and the number of credits processing requires at any time.

5. Lifetime Access (Mac App)

Lifetime Access is a one-time in-app purchase in the CrispVid app for Mac that lets you process videos in the Mac app without using credits, subject to the Service's limits (for example on video length and resolution). It is purchased through the App Store and tied to the Apple Account (Apple ID) used to buy it, not to your CrispVid account. If you lose access to that Apple Account, you may no longer be able to use or restore Lifetime Access, and we are not responsible for that. It does not include credits and does not apply to processing on crispvid.com. Refunds for App Store purchases are handled by Apple.

6. Payments

Payments on crispvid.com are processed by Stripe; purchases in the Mac app are processed by Apple. Prices may be shown exclusive of applicable taxes, which may be added at checkout.

7. Your Content

You keep your rights to the videos you submit ("Your Content"); we do not claim ownership of Your Content. You grant us a license to store, process, and transmit Your Content as needed to provide, maintain, and protect the Service and to comply with the law.

You are solely responsible for Your Content. You confirm that you own it or have all rights, licenses, and permissions needed to submit and process it, including the consent of any person who appears in it, and that it does not infringe anyone's intellectual property, privacy, or other rights. You may not submit content that is unlawful, that sexually exploits minors, that is defamatory, or that you do not have the right to use. We do not review content and have no obligation to monitor it. We may refuse or stop processing any content that we believe violates these Terms or the law.

CrispVid is not a storage or backup service. Always keep your own copy of your original videos. We are not required to keep files you submit or their results, and they may be deleted at any time.

8. Acceptable Use

You agree not to: use the Service for any unlawful purpose; copy, modify, reverse engineer, or attempt to extract the source code or processing methods of the Service; interfere with or overload the Service; access it by automated means except as we allow; get around credit, payment, or usage limits; or resell or provide the Service to others without our written permission.

9. Our Intellectual Property

The Service, including its software, processing technology, design, and the CrispVid, CRISPCORE, and SUPERSCALE names and logos, belongs to CrispVid and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in line with these Terms.

10. Deleting Your CrispVid Account

You can delete your CrispVid account from the Account page in the CrispVid app for Mac, or by contacting us. Deleting your CrispVid account is initiated by you and is permanent: it cannot be undone, and any credits remaining in the account are forfeited and will not be refunded. Deleting your CrispVid account does not delete or affect your Apple Account or Google account, which are managed by Apple and Google, or Lifetime Access purchased through the App Store with your Apple Account.

When a CrispVid account is deleted, we keep a record of the deletion request, along with payment and transaction records, for security, accounting, legal, and dispute-resolution purposes. If you sign up again later, you will receive a new CrispVid account without your previous data or credits.

11. Suspension and Termination

We may suspend or close your CrispVid account, or restrict your use of the Service, if you violate these Terms, if required by law, or to prevent fraud or harm to the Service or others. If your CrispVid account is closed for violating these Terms, remaining credits are forfeited.

12. Third-Party Services

The Service relies on third-party services, including Google and Apple for sign-in, Stripe and Apple for payments, and email delivery providers. Your use of those services is subject to their own terms and policies, and we are not responsible for them.

13. Mac App from the App Store

If you obtained the CrispVid app for Mac from the App Store, your use of the app is also subject to Apple's Licensed Application End User License Agreement. These Terms are between you and CrispVid, not Apple. Apple is not responsible for the app, its content, maintenance, or support, or for any claims relating to it, and Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the app.

14. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that results will meet your expectations.

15. Limitation of Liability

To the fullest extent permitted by law, CrispVid will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, profits, or revenue, arising from or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

16. Indemnity

You agree to indemnify and hold CrispVid harmless from any claims, damages, and expenses, including reasonable legal fees, arising from Your Content or your violation of these Terms or of anyone else's rights.

17. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing any part of these Terms is not a waiver of our right to do so later.

19. Changes to These Terms

We may update these Terms at any time. The date at the top shows when they were last changed. By continuing to use the Service after an update, you agree to the updated Terms.
